Article 2. Scope
These terms and conditions of sale (the “Terms”) apply to every order placed on bylmte.com by a consumer. By confirming their order, the customer declares that they have read and accepted them. The applicable Terms are those in force on the day of the order.
Article 3. Products
Products are described and photographed as accurately as possible on their product page (material, fit, size guide, care). Offers are valid while stocks last. As our jerseys are produced in small runs, a sold-out design will not necessarily be reissued.
Article 4. Prices
Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code (Code général des impôts). Delivery costs are added to the price of the products. They are set out in our shipping policy and shown before the order is confirmed. Prices may change at any time, but the price charged is the one displayed at the time of the order.
Article 5. Ordering
To order, the customer chooses their items, adds them to the bag, enters their contact details and delivery address, chooses a delivery method, then confirms and pays for the order. Before paying, they can check the details of their order and its total price, and correct any errors. The order is confirmed by a summary email sent to the address provided.
Article 6. Payment
Payment is made online at the time of the order, by bank card (Visa, Mastercard, American Express), Apple Pay or Google Pay. Payments are processed securely by Stripe Payments Europe Ltd.: LMTE never has access to your bank details. Your bank may ask you to approve the payment (3D Secure). The order is only registered once the payment has been accepted.
Article 7. Delivery
Orders are shipped within 2 to 4 working days, to the destinations and at the rates and delivery times set out in our shipping policy. The risk of loss or damage passes to the customer when they receive the parcel. In the event of late delivery, the customer may, after asking us to deliver within a reasonable additional period and if this request is not met, cancel their order and be refunded (articles L. 216-1 et seq. of the French Consumer Code (Code de la consommation)). For deliveries outside the European Union, any customs duties are payable by the recipient.
Article 8. Right of withdrawal
The customer has 14 days from receipt of their order to withdraw, without having to give a reason. They inform us of their decision by a clear statement (by email to contact@bylmte.com) or by using the form below. They then send the items back within 14 days of this communication. Return shipping costs are paid by the customer.
We refund all sums paid, including the original delivery costs (on the basis of the standard delivery rate), within 14 days of receiving the customer’s decision. The refund is made using the same payment method as the order. We may withhold it until we have received the items or proof that they have been sent back. The customer may be held liable for any loss in value of the items resulting from handling other than what is necessary to establish their nature, characteristics and functioning (for example an item that has been worn or washed).
Article 9. Legal guarantees
Independently of any commercial guarantee, LMTE is bound by the legal guarantee of conformity (articles L. 217-3 to L. 217-20 of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code (Code civil)).
Legal guarantee of conformity. The consumer has two years from delivery of the goods to claim under the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared. The legal guarantee of conformity includes the obligation to provide all updates necessary to keep the goods in conformity. It entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them. If the goods are repaired under the guarantee, the consumer benefits from a six-month extension of the initial guarantee. If the consumer asks for the goods to be repaired but the seller imposes a replacement, the legal guarantee of conformity is renewed for a period of two years from the date the goods are replaced. The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and receive a full refund in exchange for returning the goods, if: 1° the seller refuses to repair or replace the goods; 2° the repair or replacement of the goods takes place after a period of thirty days; 3° the repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods; 4° the lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity. The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. In that case, the consumer is not required to request repair or replacement of the goods first. The consumer is not entitled to terminate the sale if the lack of conformity is minor. Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the restored goods are delivered. The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the French Consumer Code. A seller who, in bad faith, obstructs the application of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).
Guarantee against hidden defects. The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.
For any claim, write to contact@bylmte.com with your order number and a photo of the defect. Return shipping costs for a faulty item are paid by us.
Article 10. Customer service
For any question or complaint: contact@bylmte.com or +33 6 05 75 35 91. We reply within 24 working hours.
Article 11. Personal data
The data collected when an order is placed is used to process it and to manage the customer relationship. How it is used and your rights are detailed in our privacy policy.
Article 12. Mediation
In the event of a dispute, the customer first contacts our customer service. If no agreement is reached, they may use a consumer mediator free of charge. Our mediator is currently being designated: their contact details will be provided here very shortly.
Article 13. Governing law
These Terms are governed by French law. If no amicable solution is found, the dispute will be brought before the competent courts. The consumer may, at their option, bring the matter before the court of the place where they lived at the time the contract was concluded or the damaging event occurred.
